Our Retail Team assists our many clients in the retail sector with all aspects of their businesses. We deal with everything from major projects such as property acquisitions through to advising on all aspects of legal issues associated with retailing such as employment disputes.

The commercial and IP/IT lawyers on the Retail Team enable us to provide up to the minute advice to those businesses with significant on-line activities. They also deal with common problems such as trade mark infringements, passing off and the protection of ideas and products.

The real estate/ property specialists on the team have enormous experience to draw on in dealing with the often fast paced and time pressured acquisitions and renewals that frequently coincide with prime selling periods. Together they also play a vital role in assisting franchisors and franchisees in relation to what can be complicated property and franchising arrangements issues.

The team deals with stores and leases in high streets across our region and beyond. We also have the necessary experience in relation to the large "destination" malls. Amongst others, we have dealt with leases for clients in the White Rose Centre, Leeds, the Metro Centre, Gateshead, the Trafford Centre, Manchester, Lakeside in Kent and the St David’s Centre in Cardiff.

Key work areas include:

  • New leasehold acquisitions off-plan for malls being developed
  • Standard leasehold acquisitions including assignments
  • All integrated aspects of acquiring retail units including dealing with the agents and shop fitters and negotiating and agreeing licences for alterations for shop fit purposes
  • Employment advice covering everyone from senior management to shop assistants
  • Drafting and preparing employment contracts
  • Redundancy and unfair dismissal issues
  • Transfer of Undertakings Regulations (TUPE) where applicable
  • Preparing franchise documents on behalf of franchisors
  • Reviewing and negotiating franchise documents on behalf of franchisees
  • Negotiating supply contracts
  • Reviewing commercial conditions, in particular for internet based sales
  • Advising on all aspects of intellectual property and branding
  • Advice in relation to registering an EU domain name
