Important change in the law regarding workers

If you or any of your contacts have any workers who are self-employed, there has been a recent important change in the law which could be relevant to you. Some workers are entitled to paid annual leave.
The change in the law means that individuals who are entitled to receive holiday pay can now claim for all the years they have not received that pay. Depending on the terms of their contract and the business practice, individuals who on the face of it are self-employed may in fact be 'workers' and now entitled to backdated holiday pay. The potential liability may be onerous particularly in light of the courts favouring 'worker' status over 'self employed' status.
It is anticipated that the law over the next 6 to 9 months will change further in favour of 'workers' rights. There is therefore, an increasing risk to business of unanticipated liability arising. There are steps that can be taken to mitigate the risk to business of this change. We are advising a number of our clients on those changes and the steps to take.
